These Terms of Service ("Terms") govern your enrollment in and use of the Generator Care maintenance subscription program ("Program") offered by Bates Electric, Inc. (in Florida, S.E. Bates Electric) ("Bates Electric," "we," "us," or "our"). By signing up at generator.bates-electric.com or otherwise enrolling in the Program, you ("Customer," "you") agree to these Terms.

1. The Program

Generator Care is a recurring subscription that provides scheduled preventative maintenance visits for residential or commercial standby generators within Bates Electric's service area.

Each subscription tier includes a defined number of preventative maintenance visits per twelve-month period, performed by Bates Electric technicians at intervals appropriate for the generator's make, model, and runtime. Specific services performed at each visit (oil/filter changes, fluid and filter replacement, battery and connection checks, load bank testing if applicable, etc.) are defined by the tier you select at signup and may vary by generator size and configuration.

Add-on services (e.g., battery replacement, coolant flush or top-off, transfer switch and outage simulation, exterior wash) are available for additional charge and are not included in the base subscription.

2. Eligibility and Service Area

The Program is available only for generators located within Bates Electric's normal service area. If you are outside that area, we may decline enrollment or charge an additional travel fee, disclosed before any charge is made.

You must be the owner of the generator (or have authority from the owner) and be at least 18 years old to enroll.

3. Billing

3.1 Recurring charges

You authorize Bates Electric to charge the payment card you provide at enrollment, and then automatically at each renewal: every 6 months for Semi-Annual plans, or annually for Annual plans, at the plan price shown at checkout. Charges continue until you cancel.

3.2 Add-on charges

You authorize Bates Electric to charge the same payment card on file for add-on services performed at your direction or upon recommendation accepted by you. Add-on charges will appear on your statement under "Bates Electric" with a description of the service.

3.3 Failed payments

If a recurring or add-on charge is declined, we will email you a link to update your card. If payment is not resolved within 14 days, we may suspend service visits and the next scheduled visit will be cancelled. Persistent non-payment may result in cancellation of your subscription.

3.4 Price changes

We may change subscription pricing or add-on pricing with at least 30 days' notice by email. You may cancel before the change takes effect; otherwise the new price applies at your next renewal.

4. Scheduling and Service Visits

We will contact you in advance of each scheduled visit to confirm a date and time window. You agree to provide reasonable access to the generator on the scheduled date.

If you are not available or the generator is inaccessible at the scheduled time, we may reschedule. Repeated missed appointments may, at our discretion, result in a missed-visit charge or forfeiture of that visit within the billing cycle.

5. Cancellation and Refunds

You may cancel your subscription at any time by contacting our office at (636) 464-3939 or generators@bates-electric.com.

Cancellation takes effect at the end of your current billing period. Already-completed visits within that period are not refunded. Pre-paid visits not yet performed at the time of cancellation are not refunded except where required by law or at our sole discretion.

Add-on charges for services already performed are not refundable unless the work is defective, in which case Section 7 (Warranty) governs.

6. What's Not Included

The Program is preventative maintenance only. The following are not included and are billed separately at standard rates if requested:

We will obtain your authorization before performing any non-Program work and charging your card.

7. Warranty

Workmanship on Program maintenance visits and add-on services is warranted for ninety (90) days from the date of service. If a covered defect arises during that period, contact us and we will re-perform the work at no charge. This warranty does not cover parts (which carry the manufacturer's warranty), customer-supplied parts, or failures caused by misuse, accident, vandalism, weather, fuel quality, or normal wear.

8. Limitation of Liability

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for damages arising from generator failure, power loss, food spoilage, business interruption, or property damage, except where such liability cannot be limited under applicable law.

Nothing in this section limits liability for personal injury, death, fraud, or any other liability that cannot be excluded under Missouri law.

9. Communications and Electronic Records

By enrolling, you consent to receive transactional emails about your subscription (welcome, receipts, visit reminders, payment failures, card-update links). These are required to operate the Program. You may withdraw consent only by cancelling your subscription.

You consent to the use of electronic signatures and electronic records as the equivalent of paper records.

10. Privacy

Our Privacy Policy at https://generator.bates-electric.com/privacy.html describes what information we collect, how we use it, and the choices you have. By enrolling you acknowledge that policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be emailed to active subscribers at least 30 days before they take effect. Continued enrollment after the effective date constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Program will be resolved exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to the personal jurisdiction of those courts.
